OxyElite Liver Damage Claims Under Investigation by Morgan and Morgan

(Medical-NewsWire.com, December 10, 2013 ) Tampa, FL– Morgan and Morgan has launched an investigation into the dietary supplement OxyElite Pro after an outbreak of liver illnesses in Hawaii was reportedly linked to the product. According to an FDA news release,* more than half of the patients whose medical records were submitted to the agency reported taking OxyElite Pro before falling ill, with two patients requiring liver transplants and one dying as a result of his illness. In light of this information, the attorneys at Morgan and Morgan are investigating potential claims on behalf of OxyElite Pro users who suffered from liver failure, liver damage, or hepatitis. The Hawaii Department of Health submitted nearly 50 medical records for patients who suffered liver illnesses to the FDA in October. After reviewing the records, the agency found that 58 percent of the patients had taken OxyElite Pro, with 63 percent of those patients reporting that OxyElite Pro was the only dietary supplement they had taken.*

The FDA sent a letter** to OxyElite Pro’s manufacturer, USPlabs, about the liver illness outbreak in Hawaii and warned that if the company did not issue a recall on its OxyElite Pro products, the agency would be forced to cease all distribution of the supplement by way of law. The recall, as announced by the FDA on November 9,* includes all lots and sizes of OxyElite Pro Super Thermo capsules, OxyElite Pro Ultra-Intense Thermo capsules, OxyElite Pro Super Thermo Powder, and Raspberry Lemonade OxyElite Pro Super Thermo Powder. According to its recall notice, the FDA also stated that the dietary supplement is “adulterated” because it contains aegeline, an ingredient that has not previously been found in the food supply and “lacks a history of use or other evidence of safety.”

“The fact that there have already been reports of two liver transplants and one death seriously raises our concerns over the safety of the supplement,” attorney Laura V. Yaeger of Morgan and Morgan’s Mass Tort group said. “This isn’t just centralized to Hawaii, either. There have been reports of liver illnesses linked to OxyElite in at least two other states.”

Patients in Ohio and California have also reported liver damage after taking OxyElite Pro, and the victims’ physicians have warned that they may need liver transplants, according to articles published on NBC San Diego*** and Cleveland.com**** on November 14. The attorneys at Morgan and Morgan have reason to believe that more consumers may have suffered acute hepatitis, liver damage, or acute liver failure due to their use of OxyElite Pro, and are currently investigating claims on behalf of these individuals.
